Please read these terms and conditions carefully before using the https://www.poop-patrol.net website and pet waste removal services operated by Poop Patrol LLC (known as*service provider.) By acceptance of service, client agrees to the terms and conditions listed herein.
Terms and Conditions of Service:
Service Provider and its employees guarantee the quality, reliability, and professionalism of our services. By accessing and using Poop Patrol service, you, the customer, accept and agree to be bound by the terms and provision of this agreement. In addition, when using any of our services, you shall be subject to any posted guidelines or rules applicable to such services. Any participation in this service will constitute acceptance of this agreement. If you do not agree to abide by the outlined guidelines, please do not use this service. All below items are predicated based on territory and subject to change at any time:
Types of Services:
Service provider provides the following services: clean up service, one time service, one week service, or one month service as well as 3 months to 1 year service. Subscription services are paid in advance, before services are rendered. All non-subscription services are paid at the conclusion of the week of service. If customer cancels subscription services, customer will be charged the difference of normal, one time service and their subscription service for each subscription that has taken place. Customer will not be charged for any new services that have not yet been rendered. It is at the service providers discretion to continue service if the customer moves to another address. It is also at the providers discretion to move the service date pending the address of customers new address. If client cancels their subscritption The Day of Service may change if you move out of that days pickup zone.
Cancellation:
If customer desires to cancel services with provider, customer must do so prior to 48 hours to the day of service. Cancellations which occur within 48 hours will be charged for services.
Consent to Contact:
Cell Phone Calls/Text and Emails. By providing your cell phone number and/or email address, you consent to receiving such calls or electronic communications at the number or email address provided, including but not limited to, communication attempts (calls, text messages, emails or other electronic means) made by automated telephone dialing system, prerecorded messages or artificial voice. This consent is for Service Provider and any affiliates, including any and all third-party entities hired by Service Provider for billing, collections, or customer care services. Electronic documents will be delivered to customer via to the email address that customer provided to service provider.
Satisfaction Guarantee:
If for any reason, Client is not completely satisfied with any Service Client receives, Service Provider will do its best to revisit the same day. Revisit requests must be made within 24 hours after completion of the last Service, after which all work is final and no revisits will be provided free of charge. Service Provider always does its best to work with Client to resolve any issue to Client’s satisfaction within the guidelines of these Terms of Service. Service provider will not provide a refund for such services.
Fee Payment::
Payment is due in accordance with the payment plan selected by Client at the time of accepting the Services. Some areas require sales tax on Services. If Client lives in an area where sales tax applies, Client will also be responsible for the tax amount. In addition to any amounts owed to Service Provider, Client agrees to be responsible for all reasonable collection and attorney’s fees Service Provider may incur in seeking to bring Client’s account to current.
Refunds:
Service Provider does not offer refunds for payment of Services unless the reason is an error on our part. If a refund is to be given for any reason, other than the fault of our own, refunds will be given minus bank/credit card processing fees and any proration of services, if relevant. Account credits may be given on a case-by-case basis and they will either reflect on the following month’s invoice or remain on Client’s account without expiration.
Payment Method and Billing:
At the time of acceptance of the Services, Client shall submit to Service Provider credit card for processing of payment for the Services price per the payment terms of this Service Agreement. Client consents to Service Provider storing Client’s credit card information and charging such credit card for the fees owed under this Service Agreement. The client recognizes that Service Provider is a locally owned and operated business. If Client fails to provide an updated form of payment within ten (10) business days of notice from Service Provider that the payment method on file failed, Service Provider may terminate this Service Agreement. Services are billed the Monday after your service is completed for one time service, one week service, or one month service. Subscription services are paid in advance, before services are rendered. Service Provider accepts Visa, MasterCard, Discover and American Express. All clients have access to their account through this website. From our website you manage your account, ask questions, request or adjust service, and report concerns. You can also see your account balance, invoice and payment history.
Service Times/Days:
Service Provider is unable to provide time-specific visits due to many variables. Scooping/service hours are from sunup to sundown. Service Provider works rain or shine and in most weather conditions. If weather/road conditions become unsafe, Services will be paused until conditions return to a safe status and any Clients affected will be notified as soon as possible. From time-to-time, for any reason, Service Provider may need to reschedule or change your Service day(s) at its discretion. Service Days are dictated by Client’s address and established routes. This enables Service Provider to keep prices low and stay competitive. Client’s monthly fee includes certain holidays observed by Service Provider without compensation of cost or Service. These holidays are New Years Day, Memorial Day, Independence Day, Labor Day, Thanksgiving Day and the following Friday, Christmas week. (If Christmas day falls on a weekend, Service Provider will either close the week before or after.) In the event of inclement/extreme weather conditions or an act of God, Service Provider reserves the right to delay or cancel services out of an abundance of caution. During this time, customer will be notified of such an event and services will be rescheduled or adjusted accordingly.
Modifications:
Modifications to the Services or these Terms of Service will be made only when a written communication describing such modifications has been delivered to Client. There may be additional charges for any changes. Service Provider will provide Client with 30 days’ notice of any price changes.
Access to Property:
By employing Poop Patrol, you are granting Poop Patrol professionals’ access to designated yard or kennel areas of your property during the designated service date. If our technician is not permitted on your property for any reason or the gate to access is broken/frozen/ locked, this occurrence will be noted and customer will be charged for full price of service or canceled. Please be sure the gate/access point is free of any obstructions (i.e., dogs, padlocks, lawn furniture, etc.) and is unlocked. Technicians are not permitted, nor required to enter a customer’s home. In no circumstances will this be allowed or required of any Poop Patrol technician. There are and will be no exceptions to this rule. Although Service Provider attempts to secure all gates, Service Provider does not assume responsibility for securing client’s gates. Please check gates after service is provided.
Performance of Services:
The Services will be performed by the Service Provider on the date(s) or day(s) of the week specified unless you are notified otherwise. Client will receive service date prior to the day of service unless notified earlier.
Referral:
Poop Patrol will honor the referral policy wherein if you refer a friend and said person schedules a regular scooping subsciption service with Poop Patrol.
Locked Property:
If the assigned Poop Patrol technician is unable to access the designated yard space due to a locked gateway or gateway is not in good working order, and cannot otherwise access a customer’s property, service on chosen day will be postponed or canceled. Service may be rescheduled for a later time, but customer will be charged a trip fee equaling up to the quoted cost of service. Customer will not hold service provider liable for damaged/broken gates. Customer agrees to leave a key for Poop Patrol technician in the event gate will not be left unlocked.
Aggressive Animals:
If our assigned Poop Patrol technician is unable to access the designated yard area due to an aggressive animal presence, service on chosen day will be postponed or canceled. Service may be rescheduled for a later time, but customer will be charged a trip fee equaling up to the quoted cost of service. If an animal bites a technician, the employee will immediately leave the premises to seek medical attention. The yard will be left in “as is” condition and may be considered as Services rendered for that visit. All medical fees will be the Client’s responsibility within a reasonable time frame. Animal Control may be contacted, and/or further actions may be taken depending on the situation. The Service Provider relies on the Client’s assessment of their animal’s temperament. Please consider this for the Service Provider’s safety. The client will maintain accurate and proper vaccination records for its dog(s) and make them available to the Service Provider for inspection if requested or in the event of a dog bite/attack. The service provider reserves the right not to service any yard in which they don’t feel comfortable.
Service options:
Service options are solely based on territory and services assigned by respective franchise at given time. Service schedule availability can change based on business needs and general workday productivity. You, the customer, are responsible for notifying Poop Patrol of any changes in number of dogs, frequency of services, or items needed to provide service are not in good working order. Customer will not hold service provider liable for damaged/broken items (i.e. gate, lock on gate, hose, or hose nozzle). Customer is also responsible for notifying Poop Patrol of service cancellation and is required to do so 24 hours before service.
Insurance:
Service Provider maintains applicable local, state of federal licenses required, if any, to perform the Services as well as no less than one million dollars ($1,000,000.00) in Comprehensive General Liability insurance with an insurance company licensed to do business in the state of Tennessee.
Governing Law:
These Terms shall be governed and construed in accordance with the laws of Tennessee without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between us regarding our Service and supersede and replace any prior agreements we might have between us regarding the Service.
Terms and Conditions of Changes:
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least a day’s notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Service.
Terms and Conditions of Intellectual Property:
The Service and its original content, features and functionality are and will remain the exclusive property of Poop Patrol and its licensor’s..
Liability Release & Indemnification:
Client acknowledges that pet waste removal involves potential hazards, including but not limited to bacterial exposure, parasites, and uneven terrain. The Client agrees to release, indemnify, and hold harmless service provider, its owners, agents, and employees from any and all claims, damages, losses, or expenses (including reasonable attorney fees) arising from any injury to staff caused by the Client’s pets, including bites or injuries from chasing pets, any damage to the property, including lawns, sprinklers, or landscaping, occurring during the normal course of service as well as any injury to the Client, their pets, or third parties related to the presence of waste or the service performed.
